CRIMINAL LAW: AN OVERVIEW
Criminal law involves prosecution by the government of a person for an act that has been classified as a crime. Civil cases, on the other hand, involve individuals and organizations seeking to resolve legal disputes. In a criminal case, the state, through a prosecutor, initiates the suit, while in a civil case the victim brings the suit. Persons convicted of a crime may be incarcerated, fined, or both. However, persons found liable in a civil case may only have to give up property or pay money, but are not incarcerated.
A "crime" is any act or omission (of an act) in violation of a public law forbidding or commanding it. Though there are some common law crimes, most crimes in the United States are established by local, state, and federal governments. Criminal laws vary significantly from state to state. There is, however, a Model Penal Code (MPC) which serves as a good starting place to gain an understanding of the basic structure of criminal liability.
Crimes include both felonies (more serious offenses -- like murder or rape) and misdemeanors (less serious offenses -- like petty theft or jaywalking). Felonies are usually crimes punishable by imprisonment of a year or more, while misdemeanors are crimes punishable by less than a year. However, no act is a crime if it has not been previously established as such either by statute or common law. Recently, the list of Federal crimes dealing with activities extending beyond state boundaries or having special impact on federal operations, has grown. See Title 18.
All statutes describing criminal behavior can be broken down into their various elements. Most crimes (with the exception of strict-liability crimes) consist of two elements: an act, or "actus reus," and a mental state, or "mens rea". Prosecutors have to prove each and every element of the crime to yield a conviction. Furthermore, the prosecutor must persuade the jury or judge "beyond a reasonable doubt" of every fact necessary to constitute the crime charged. In civil cases, the plaintiff needs to show a defendant is liable only by a "preponderance of the evidence," or more than 50%.
DEFINITION FROM NOLO’S PLAIN-ENGLISH LAW DICTIONARY
Laws written by Congress and state legislators that make certain behavior illegal and punishable by fines and/or imprisonment. Criminal law also includes decisions by appellate courts that define crimes and regulate criminal procedure in the absence of clear legislated rules. By contrast, civil laws are not punishable by imprisonment. In order to be found guilty of a criminal law, the prosecution must show that the defendant intended to act as he did; in civil law, you may sometimes be responsible for your actions even though you did not intend the consequences. For example, civil law makes you financially responsible for a car accident you caused but didn't intend.

iPhone and DoCoMo is a big deal in Japan
NTT DoCoMo will finally take the plunge and carry the iPhone later this month -- so the Japanese media says. This has created quite a stir.
Japan's leading business daily, Nikkei -- where the No. 1 ranking story for readers on Friday was about the market reaction to the DoCoMo-iPhone news -- has run a series of stories trying to spell out the impact on Japan's largest carrier and the overall market.
One Friday headline asked how the "power structure" of the telecommunications market will change in Japan and pointed out that DoCoMo will have to make some uncomfortable adjustments, including a commitment to the large volume of units that Apple typically requests of carriers.
An oft-repeated theme is that DoCoMo is late to the game. Softbank, which began carrying the iPhone in 2008, has seen its market share expand on the back of Apple's phone. KDDI (au) picked up the iPhone in 2011.
So, to get new iPhone customers, DoCoMo may have to resort to more-aggressive incentive programs. Currently, DoCoMo's two top brands are Sony and Samsung.
Nikkei ran an illustrative graph of NTT DoCoMo's shrinking subscriber base. In 2003 it had 56.3 of the mobile phone market, and KDDI had 21.9 percent. "Others" had a combined 20.8 percent n March of this year, DoCoMo had 42 percent, KDDI 28.6 percent, and Softbank 29.4 percent, according to the newspaper. Note that Softbank's rise to prominence in the Japanese market is pegged to it being the exclusive provider of the iPhone until KDDI signed on in 2011.
And Yomiuri Shimbun, one of Japan's top dailies, ran a related story, showing that DoCoMo lost net subscribers in August.
On the front door of Asahi Shimbun, one Japan's largest national dailies, the No. 2 most-read story on Friday was about DoCoMo and the iPhone.
Ascii, a major Japanese tech site, on Friday ran a story making the point that NTT DoCoMo hasn't officially announced that it will sell the new iPhones -- which is true, as NTT DoCoMo states on its site.
Whatever happens, all the coverage and interest in Japan attests to the market impact the iPhone can have. A similar situation is happening in China, where that country's largest carrier, China Mobile, is expected to carry the iPhone (5C) for the first time.

With the Google Nexus 5 release date now expected to be just a matter of weeks away, latest Google Nexus 5 rumours have suggested the phone will bring a larger screen, bumped up specs and a thinner form factor to boot.

Google Nexus 5 Release Date
Latest reports have pegged the Google Nexus 5 release date as October 31. Although not having come from official avenues, the tipped Halloween arrival would fit with past Nexus launches and see the Nexus 5 look to capitalise on the pre-Christmas shopping rush. What's more, it would avoid landing too close to the September 20 iPhone 5S release date.
Claimed unnamed sources have stated: “The next Nexus phone should arrive sometime in October, possibly around October 31." This would see the phone land just weeks after the LG G2 release date.
Although there has, as yet, been no official word from Google as to when the Nexus 5 will be released, this is just one of several reports which have suggested that an October arrival is on the cards, given added backing to the claims. Given the Nexus 5 could be just weeks from arrival, the recent Nexus 4 price cut would suggest the search giant is already preparing for its next flagship phone. What's more, retailers have already started pulling the Google Nexus 4 from shelves.
In May, both Phones 4u and Carphone Warehouse reportedly stopped selling the Nexus 4, then in July the Nexus 4 disappeared from the Carphone Warehouse site entirely. Having a quick scan of all the UK network providers, the Nexus 4 is conspicuously absent, only listed as out of stock on the O2 website, and completely missing from the rest.
This could suggest a Google Nexus 5 release date may be upon us earlier than October, but of course this is just speculation on our part, especially as the Nexus 4 is still available to pruchase on the Google Play store although at a reduced price.
Google Nexus 5 Specs
The Google Nexus 5 will improve on the existing specs of the Nexus 4 with recent rumours pointing to a considerable jump in performance. A 5.2-inch OLED 1920 x 1080p Full HD display is said to be making the cut, upgrading the current 4.7-inch 1280 x 768p resolution screen.
Processor-wise the Google Nexus 5 should pack a 2.3GHZ Qualcomm Snapdragon 800 quad-core processor with an impressive 3GB of RAM. There should also be the option of 16GB, 32GB or 64GB of internal storage, probably lacking microSD card expansion like the existing flagship.
With a hearty 3300mAH Lithium Polymer battery reportedly in tow, the Google Nexus 5 should also have a 16-megapixel rear camera and Full 1080p HD video recording capabilities as well. Up front there is expected to be a 2.1-megapixel snapper for video calling and all those selfies.
As with the Nexus 4, we expect the next Google smartphone to have NFC, Bluetooth and Wi-Fi connectivity, but with 4G LTE compatibility added.
At the start of July, it was tipped that the soon-to-be-announced LG G2 will share similar specs with the Google Nexus 5. The official LG unveiling is occurring on August 7, so you could see a preview of the Google Nexus 5 hardware then.

The latest rumours suggest that the Nexus 5 will actually be made by Motorola, a company which is a fairly recent acquisition of Google itself. The new tip comes from a notoriously accurate leakster by the name of Taylor Wimberley, who wrote a Google Plus post stating the Nexus 5 would arrive in Q4 produced by Motorola.
"Motorola will release a Nexus smartphone in Q4 (that is not the Moto X)," wrote Wimberley.
Rather than introduced a Google Edition Moto X, it seems that Motorola will join together with parent company Google to produce the Nexus 5 this year.
However, completely contradicting these claims is the latest rumour that LG will build the Nexus 5 smartphone after all.
According to the South Korean MyDrivers website on August 13, the Nexus 5 will not only be made by LG but also be designed on the recently unveiled LG G2.
